    Powell Legal Counsel, Ltd is an Illinois law firm, and has created this privacy statement in order to demonstrate our firm commitment to privacy. The following discloses our information gathering and dissemination practices regarding the Personal Data, (as defined below), we may collect from users of this web site: http://www.powelllegal.com/ (the "Site") and the data, text, reports, documents, templates, agreements and other materials that may be made available or enabled via any affiliate client portal site (collectively - "the PLC Site").

    Children Visitors

    We do not intentionally gather Personal Data from visitors in the US who are under the age of 18. If a child under 18 submits Personal Data to the PLC Site and we learn that the Personal Data is the information of a child under 18, we will attempt to delete the information as soon as possible.     What Does the Privacy Policy Cover?

    This Privacy Policy covers the treatment of personally identifiable information gathered when you are using or accessing this PLC Site. This Privacy Policy does not apply to the practices of third parties who are not affiliates or who we do not own or control.

     

    The statistics program on our web server collects aggregate information on what pages consumers access or visit which we use for internal review and to improve the content of our web site. This information is not personal information. EMAIL addresses collected from this Web Site are never sold or rented, and are archived. Personal contact information is collected in connection with the purchase of our Services and is used for accounting purposes (e.g., process a refund) or to contact you if there is a problem with your purchase.     What Information Do We Collect?

    Information You Provide to PLC

    We may collect Personal Data from you such as:

    • your first and last name, e-mail, mailing address, and phone number,
    • when you purchase documents and/or services through the PLC Site (we will use your name and email address only to communicate with you, and we will not sell, rent or distribute your name or email address to any third party or use it for any marketing purpose for which you have not subscribed). 
    • when you provide us feedback, post information or contact us via e-mail, (we will collect your name and e-mail address, as well as any other content included in the form, in order to send you a reply), and/or
    • at other points in the PLC Site that state that Personal Data is being collected.

    Information Collected Using Technology

    Information Collected by Servers: To make the PLC Site more useful to you, our servers (which may be hosted by a third party service provider) collect information from you, including your browser type, operating system, Internet Protocol (“IP“) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and/or a date/time stamp for your visit.

     

    Log Files: Similar to most websites, we gather certain information automatically and store it in log files. This information includes IP addresses, browser type, Internet service provider (“ISP“), referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information to analyze trends, administer the PLC Site, track users’ movements around the PLC Site, and to gather demographic information about our user base as a whole.     Do-Not-Track Browser Setting: We do not currently respond to Do-Not-Track ("DNT") signals from web browsers (known under the California Online Privacy Protection Act (CalOPPA)). Although most web browsers and some mobile operating systems and mobile applications do include a DNT feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored or collected, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, this is the reason we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted in the future that we must follow, we will inform you about that practice in a revised version of this privacy policy.

     

    Pixel Tags: We may use “Pixel Tags” (also referred to as clear Gifs, Web beacons, or Web bugs). Pixel Tags are tiny graphic images with a unique identifier, similar in function to Cookies, that are used to track online movements of Web users. In contrast to Cookies, which are stored on a user’s computer hard drive, Pixel Tags are embedded invisibly in Web pages. Pixel Tags allow us to send e-mail messages in a format users can read, and they tell us whether e-mails have been opened to ensure that we are sending only messages that are of interest to our users. We may use this information to reduce or eliminate messages sent to a user. We do not tie the information gathered by Pixel Tags to our users’ Personal Data.

     

    Collection of Data by Advertisers: We do not use third parties to serve ads on the PLC Site or collect personally identifiable information about your online activities over time and across different websites.

     

    Google Analytics: We may use Google Analytics to help analyze how users use the PLC Site. Google Analytics uses Cookies to collect information such as how often users visit the PLC Site, what pages they visit, and what other sites they used prior to coming to the PLC Site. We may use the information we get from Google Analytics only to improve the PLC Site. Google Analytics collects only the IP address assigned to you on the date you visit the PLC Site, rather than your name or other personally identifying information. We do not combine the information generated through the use of Google Analytics with your Personal Data. Although Google Analytics plants a persistent Cookie on your web browser to identify you as a unique user the next time you visit the PLC Site, the Cookie cannot be used by anyone but Google.     Although we take appropriate measures to safeguard against unauthorized disclosures of personally identifiable information, we cannot guarantee that personally identifiable information in our possession on the main Powell Legal Counsel, Ltd website, (i.e.; via the Contact Us or Sign up forms), will never be disclosed in a manner that is inconsistent with this Privacy Policy. We otherwise store all of our information, including your IP address information, using industry-standard techniques.     Changing or Deleting Your Personal Data: Personal Data submitted for document generation is deleted daily by an automated process. Personal Data submitted for other purposes will be retained for such period as may be required to fulfill the purposes set out in this Privacy Policy, or such other period as may be required by law. You may request deletion of your Personal Data by us, and we will use commercially reasonable efforts to honor your request, but please note that we may be required by law to keep such information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database, but may remain in our archives.

     

    Your Data Protection Rights as a California Resident: California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits users of the PLC Site, who are California residents, to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.
